  1. Introduction

This Refund Policy outlines the terms and conditions regarding refunds for subscriptions and services purchased through the A-Game Business App (“the Platform”, “we”, “us”, “our”). By subscribing to any of our paid plans, you acknowledge that you have read, understood, and agree to be bound by this Refund Policy.

A-Game Business App is operated by A-Game Business Consulting (Pty) Ltd, Registration Number: 2015/338118/07, a company registered in South Africa.

 

  1. Our No-Refund Policy

Due to the nature of our services, A-Game Business App operates a strict no-refund policy for all subscription plans and services.

This policy exists because:

  • AI-Powered Services: Our Platform integrates advanced artificial intelligence features powered by third-party AI services (including OpenAI). Once AI credits are consumed on your behalf, these costs cannot be recovered by us.
  • Immediate Service Delivery: Upon payment or trial activation, you receive immediate and full access to all features included in your subscription tier. These digital services are delivered instantly and cannot be “returned.”
  • Credit Abuse Prevention: Allowing refunds after AI credits have been consumed would expose our business to significant risk of abuse, where users could consume expensive AI resources and then request refunds.
  • Third-Party Costs: We incur immediate costs from third-party service providers (AI providers, payment processors, infrastructure) that are non-recoverable.

14-Day Free Trial: All new subscribers to paid tiers (Starter, Business, Scaleup) are entitled to a 14-day free trial period. During this trial, you have full access to evaluate whether the Platform meets your needs.

We strongly encourage all users to utilise the full 14-day trial period to evaluate the Platform before committing to a paid subscription.

 

  1. What We Do Not Refund

We do not provide refunds under the following circumstances:

  • Subscription Fees: Monthly or annual subscription payments are non-refundable once processed.
  • Trial-to-Paid Conversions: If you do not cancel before your trial period ends, your payment method will be charged automatically. These charges are non-refundable.
  • Unused Subscription Time: If you cancel your subscription mid-cycle, you will retain access until the end of your billing period, but no pro-rata refunds will be issued.
  • Dissatisfaction After Trial: If you completed your 14-day trial and subsequently subscribed, claims of dissatisfaction with features or functionality are not grounds for a refund.
  • Failure to Use the Service: Non-use or partial use of the Platform during your subscription period does not entitle you to a refund.
  • Change of Mind: Deciding you no longer need the service after payment is not grounds for a refund.
  • Business Closure: If your business closes or you no longer require the service, no refund will be issued.
  • AI Credit Consumption: Any request for refund after using AngelAI or other AI-powered features will be declined, regardless of usage volume.
  • Duplicate Payments: In the case of genuine duplicate payments caused by technical error, we will refund the duplicate charge only. Please contact support with transaction details.

 

  1. Subscription Cancellation

You may cancel your subscription at any time through your account settings or by contacting our support team.

Cancellation Terms:

  • Cancellation takes effect at the end of your current billing period
  • You will retain full access to your subscribed tier until the period ends
  • After the period ends, your account will be downgraded to the Free tier
  • No refunds are issued for the remaining time in your billing period
  • Your data will be retained according to our Data Retention Policy

To cancel your subscription:

  1. Log in to your A-Game Business App account
  2. Navigate to Settings > Subscription
  3. Click “Cancel Subscription”
  4. Confirm your cancellation

  1. Exceptional Circumstances

We may, at our sole and absolute discretion, consider refund requests in the following exceptional circumstances:

  • Service Unavailability: Extended platform outage exceeding 72 consecutive hours that materially prevented you from using the service (verified downtime only)
  • Billing Errors: Charges that occurred due to a verified technical error in our billing system
  • Fraudulent Transactions: Unauthorised charges where you can demonstrate your account was compromised (subject to investigation)

  • Include: Account details, transaction reference, detailed explanation, and any supporting evidence

All exceptional refund requests are reviewed on a case-by-case basis. Submission of a request does not guarantee approval. We reserve the right to decline any refund request.

 

  1. Chargebacks and Disputes

If you initiate a chargeback or payment dispute with your bank or payment provider without first attempting to resolve the issue with us:

  • Your account will be immediately suspended pending investigation
  • You may be permanently banned from using the Platform
  • We reserve the right to dispute the chargeback with evidence of service delivery
  • Any costs incurred by us in disputing fraudulent chargebacks may be pursued as a debt

We strongly encourage you to contact our support team before initiating any payment disputes. We are committed to resolving legitimate billing issues promptly.

 

  1. Enterprise Plans

Enterprise plan pricing and refund terms are governed by individual service agreements. If you are an Enterprise customer, please refer to your signed contract for applicable terms, or contact your dedicated account manager.

 

  1. Consumer Protection Act (South Africa)

While we operate a no-refund policy, we acknowledge the provisions of the Consumer Protection Act (CPA) of South Africa.

Section 16 – Right to Cool Off:

  • For direct marketing transactions, consumers have a 5 business day cooling-off period
  • This applies ONLY if you subscribed as a result of direct marketing (not self-initiated sign-up through our website)
  • This right does not apply if services have already been rendered or digital content has been accessed

  1. How to Avoid Unwanted Charges

To avoid charges you do not wish to incur:

  1. Use the Full Trial Period: Test all features during your 14-day trial before subscribing
  2. Set Reminders: Note your trial end date and set a reminder 3-5 days before
  3. Cancel Before Trial Ends: If the Platform is not suitable, cancel before your trial ends
  4. Review Before Payment: Review your subscription tier and billing cycle before confirming
  5. Monitor Your Email: We send billing reminders before processing payments

 

  1. Payment Processor

All payments are processed through Paystack, a PCI-DSS compliant payment processor. A-Game Business App does not store your credit card or bank account details.

We reserve the right to modify this Refund Policy at any time. Changes will be effective immediately upon posting to our website. Your continued use of the Platform after any modifications indicates your acceptance of the updated policy.
